An investment in real estate or other real property can provide unique investment portfolio benefits. Property owners often seek a steady stream of income, capital appreciation and property-related tax advantages. Yet some property owners may no longer be interested in actively owning and managing property, but still want an allocation in real estate. For those individuals, securitized fractional real property investing may be a good fit.
1031 EXCHANGE STRUCTURE
It is important to note that the identification period (45 days) and the closing period (180 days) run concurrently and make no concession for weekends and holidays.
Required by the IRS for a valid Exchange, a qualified intermediary (also known as a “facilitator” or “accommodator”) is the entity that receives the sales proceeds upon the sale of the investor’s relinquished property, holds onto the proceeds while the Replacement Property is identified, and releases the funds to acquire the 1031 Exchange replacement property.
This is a critical step, and without it, the 1031 Exchange will be declared invalid by the IRS.
